EU Data Act (EUDA) becomes applicable on September 12, 2025
The EU Data Act (EUDA), officially titled Regulation (EU) 2023/2854 of the European Parliament and of the Council of 13 December 2023, takes effect on September 12, 2025. This regulation introduces a new framework governing the access to and use of data generated by connected products*1 and related services offered within the EU market*2. Designed to foster a more equitable and efficient data economy, the EUDA establishes clear rules regarding who may access such data, under what conditions, and which types of data are subject to these provisions—particularly those originating from connected products.
*1 According to EUDA, a ‘connected product’ means an item that obtains, generates or collects, by means of its components or operating systems, data concerning its performance, use or environment and that is able to communicate those data via an electronic communications service, a physical connection or on-device access, and whose primary function is not the storing, processing or transmission of data on behalf of any party other than the user; prototypes are excluded.

*2 The term “EU market” refers to the collective markets of the European Economic Area (EEA), within which the EU Data Act is applicable. This includes the Member States of the European Union as well as Iceland, Liechtenstein, and Norway. For the purposes of this document, all of these jurisdictions are encompassed within the definition of the “EU market.”
